Abstract The purpose of the article is to analyse the international, state and Catalan regulations applicable to the incorporation of new information and communication technologies in the provision of non-university educational services. It studies the evolution of this regulation following the acceleration of the use of new technologies in classrooms during the covid-19 pandemic and post-pandemic, as well as the harmful impacts that have been revealed for the health and well-being of people, especially minors. The proposal emphasizes the obligation of public administrations to respect the best interests of the minor in all their actions. In addition, it highlights the responsibility of public administrations to guarantee respect for the fundamental rights to education, to honour, to privacy, to one’s own image and the protection of personal data in the teaching of digital competence as well as in the use of digital devices in educational centres.
