Abstract

This study reflects on the possibility of separating, in a historical perspective dating prior to the Decree of Nova Planta of 1716, civil or private law from public law in the Catalan legal system. This is an issue that arises as a result or consequence of Catalonias unique political regime based on pact-making, a model that engenders a series of social and political behaviours: a political logic and a way of doing things in Catalan society that is expressed in Catalan laws via different constitutions. A system, however, that was dismantled by the Decree of Nova Planta that abolished public law and institutions and sustained Catalan private law.
