Abstract

This paper deals with the historical provisions of law in Barcelona and Tortosa addressed directly or indirectly to protecting water and preventing its pollution. It focuses on the legal guardianship of water, one of the elements comprised by the concept of environment as we know it today. A review is made of the antecedents in ancient law and in the Roman legal system, with references to the Liber Iudiciorum because of the importance it held in Catalan territory and to specifically Catalan legal sources, such as the charters of settlement and franchise, the Recognoverunt proceres, the Ordinacions dEn Sanctacília, the Costums de Tortosa and the Usatges, and in the modern age the Cortes or Estates-General of Monzón in 1585 and those of Barcelona in 1564, 1599, 1702 and 1706.
