Abstract

This paper presents a study involving an analysis of the concept of the legal incompetence of persons with Alzheimers disease, and of possible viable alternatives to this institution. We seek to highlight the incidence and importance of this disease at present from two perspectives: the purely medical standpoint (relating to symptomatology and the diseases effects on the person), and the juridical standpoint (focused on legal incompetence and its alternative legal figures). The latter perspective forms the cornerstone of this study. We also seek to establish whether legal incompetence is a sufficiently plausible institution or, on the contrary, whether the State should promote the application of its alternative figures since they are less burdensome for persons with Alzheimers.
