Abstract

This paper deals with the way in which jurisdictional proceedings treat the preventive annotation of a bequest as a precautionary measure, taking as a reference the regulation of the Civil Procedure Act process with its special particularities and the regulation of the procedural aspects in the Mortgage Law and the Mortgage Regulations. The author proposes a combination of the two regulations through an integrating normative interpretation of practical character.
