Price modification in energy supply contracts

Abstract

The aim of this study is to identify and analyse the rules governing price modifications in electricity supply contracts in the so-called free market. The analysis is based on European law and includes its implementation in domestic law. The exercise reveals that the terminological alignment between sector specific and general regulations is not always perfect and clear, especially when distinguishing between related categories such as price modification, revision or adjustment. From an operative perspective, while sector specific legislation primarily focuses on the legal requirements that must be met for a price change to be valid, general legislation only addresses the contractual clauses that may authorize the supplier to make a change or modification.
