Abstract This paper builds on the impact of the recent CJEU ruling in the SCHUFA case regarding the use of AI in the creditworthiness assessment. In the analysis, the recently approved AI Regulation, as well as the latest reform of the Consumer Credit Directive in 2023 have been considered in order to determine the path that the European Union is following with regards to the use of AI in the consumer’s realm. With all these elements in mind, it has been assessed the most problematic issues arising in this field, in addition to drawing attention to the successes and challenges ahead.
