Thoughts on a simplification and modernization of testamentary forms in book 4 of the Catalan Civil Code

Abstract

This paper proposes an update of the Catalan inheritance law in terms of testamentary forms. On the one hand, the suppression of the secret will. On the other hand, the reconfiguration of the holographic will, seeking inspiration in the ancient parentum inter liberos, so that it only admits attributions to the spouse or cohabitant and children, to avoid excessive judicialization. Subsequently, it is proposed to allow the use of new technologies without affecting the authenticity of the holographic form.
