Abstract

This work aims to be a journey through the history of civil law in the Balearic Islands, from the Conquest of Mallorca in 1229 to the Compilation of special civil law of 1961, from the point of view of the formation of private sources or civil law. The history of law, in relation to the Balearic Islands, deals with the legal system that has been established in them at each time and with municipal law or iura propia. From these orthodox studies, the present work builds, in parallel, an iter or legal history of the legal-civil precedents, with the central nucleus of the emergence and the subsequent trajectory of the ius commune in the Balearic Islands; to conclude with the fact that the existence of the ius commune, despite its own meanings and connotations, was the foundation and justification for the 1961 Compilation.
