Comentari de la sentència del Tribunal de Justícia de la Unió Europea de 9 de març de 2017 Authors Adrian Di Pizzo Chiacchio Abstract The request for a preliminary ruling that we will examine below was raised before the Court of Justice of the European Union (CJEU) by the Supreme Court of Cassazione (Italian Supreme Court) regarding the joint interpretation of article 3 of Council Directive 68/151/EEC of 9 March 1968 currently repealed and replaced by Directive 2009/101/EC on the compulsory advertising of certain circumstances in relation to commercial companies; and article 6, ap. 1, letter e, of Directive 95/46/CE, on the principle of quality of the treatment of personal data.The issues raised highlight the collision between, on the one hand, the interests of legal- economic traffic in protecting the principle of registration advertising (in this case, as regards the registration of societies of Lecce) and, on the other hand, the right to protection of personal data that concerns a natural person who in the past has been linked to a company as a bankruptcy and liquidator administrator.
