Comentari de la sentència del Tribunal Superior de Justícia de Catalunya 12/2017, de 13 de març de 2017 (RJ/2017/2082) Authors Rosa Barceló Compte Abstract The judicial decision nº 12/2017, of 13 of March, excludes the possibility to rescind a contract of real state direct awarding justifying it because of the similar nature of this figure with the auction procedure, which is kept out from the application of laesio enormis doctrine under the article 321 of the Catalan compilation of civil law. However, under the new regulation on obligations and contracts of the Catalan civil code, the exclusion of the auction procedure from the rescission remedy disappears.
