Abstract

Article 621-44 of the Catalan Civil Law rules the terms of extinction of claims and measures that, in purchase sales agreements, are attributed to the buyer and seller if the other party fails to comply with the contract. Although the regulation of the precept seems clear, it's interpretation creates some questions regarding what really extinguishes when the legally established period of time passes, which is the nature of this period of time and what are the effects that derive from it, as well as what are the requirements to establish the moment in which this period begins to count. This work intends to solve these doubts.
